This response came after Lowell’s message on Friday, which stated that they would accept a “new proper” subpoena if it were to be issued.

Back in December, Hunter Biden agreed to provide public testimony but refused to comply with a congressional subpoena for a closed-door testimony, resulting in outrage from House Republicans. In response, Comer and Jordan initiated the process of holding Biden in contempt of Congress for defying the December subpoena, and a vote on this matter is scheduled to take place next week. However, in Lowell’s letter, he argued that the initial subpoenas were legally invalid since they were issued before the formalization of the presidential impeachment inquiry they served.

The Response and Criticism

Comer and Jordan firmly denied Lowell’s claim that the subpoenas were invalid, emphasizing that they did not believe his assertions had any merit. Additionally, Lowell criticized the two committee chairs for pursuing a vote to hold Biden in contempt, despite his agreement to provide public testimony. It is worth noting that Jordan himself is facing scrutiny after refusing to respond to a subpoena to testify about former President Donald Trump’s involvement in the U.S. Capitol insurrection on January 6. At the time of writing, there has been no response from Lowell, Comer, or Jordan regarding these criticisms.
